San Diego’s March 2020 ballot measure that would have raised hotel tax to fund convention center expansion, homeless services and street repairs gets some help from a new ruling of the state appeals court that an Oakland tax initiative only needed a simple majority to pass.

While San Diego will soon go to court with a case in itself to validate the hotel tax initiative – Measure C – the latest ruling is now part of several appeals court rulings asserting that a qualified majority is not not required to adopt such measures.

Like San Diego, Oakland initially took the position that a two-thirds majority was needed to pass its parcel tax measure, which was put to the November 2018 ballot by a group of citizens. He subsequently estimated, just as the San Diego city council did last April with measure C, that the tax initiative had prevailed with a simple majority of voters.

Last year, the city of San Diego filed what is known as a validation action asking the court to determine that Measure C was legally passed even though it did not achieve a two-thirds majority including voters. at the time had been informed that it was required for approval. The latest decision in the Oakland case now marks the fourth appeal court ruling finding that simple majority approval is sufficient when a tax increase is written on the ballot by citizens, which was the case with measure C.

“The decision on appeal is a positive sign for the 65% of San Diego voters who have supported significant new funding to address urgent civic needs,” San Diego City Attorney’s Office Mara Elliott said Monday, in a press release. “In particular, Measure C’s potential to provide $ 2.1 billion to programs for the homeless has become all the more urgent during the pandemic, compounding the challenges for people who were not already protected or at risk of becoming so. “

The Court of Appeals in the Oakland case specifically dismissed an issue raised by those who challenged San Diego’s authority to declare the hotel tax hike passed even though it did not get the two-thirds majority, which is traditionally the norm in California law for tax increases or new taxes for a specific purpose.

Community nonprofit, Alliance San Diego, filed a lawsuit against the city last year, arguing it overstepped its authority by voting to effectively change the election result. He noted in his lawsuit that voters in San Diego had received “official voting documents informing them unequivocally that a two-thirds vote was required for Measure C to pass.”

The Court of Appeal in the Oakland case, however, argued that such instructions in the ballots are not sufficient to overturn the result of a vote.

“The AA measure cannot be invalidated on the basis of the voting threshold declarations of the ballot papers,” the court wrote, “because the declarations did not relate to the substantial characteristics of the measure, were not intended to be intentionally misleading and cannot derogate from the law governing the applicable voting threshold.

Isidro Ortiz, a registered voter who joined Alliance San Diego to challenge city council action related to Measure C, said on Tuesday there had been no judicial notice in the judicial district covering San Diego justifying the vote of the council declaring that the initiative had been adopted.

“Moreover, the city council waited more than a year after the March 2020 elections were allowed to act,” Ortiz said. “Elections have a finality. It is the conclusion of a process that voters should have confidence in. The city has violated this trust.

Lawyer Michael Colantuono, who represents the Yes on Measure C coalition, retorts that overall, the court’s ruling is positive for the San Diego case, which is due to go to trial in March, said

Jaymie Bradford, executive vice president of the San Diego Regional Chamber of Commerce and a leader of the pro-Measure C campaign, said in a statement that “We continue to be encouraged by the results of similar business. in the state and look forward to resolving it locally so that we accomplish what voters demanded – modernize the convention center, generate meaningful funding for the homeless, and fix San Diego’s roads. ”

The initiative was supported by a broad coalition of business, labor and tourism leaders, as well as homeless advocates, who had urged the city to seek legal validation of Measure C, given of its strong presence in the polls with 65.24% in favor of it.

If the city wins in its legal effort, an approved Measure C would increase San Diego’s 10.5 percent hotel tax to 11.75 percent, 12.75 percent, or 13.75 percent, depending on proximity to hotels with the San Diego Bay Convention Center. Seven people were injured, including one badly burned, after flames ravaged a house in the Rolando community on Sunday morning, officials said.

The two-alarm fire was reported just after 6 a.m. on Malcolm Drive near Cartagena Drive.

Firefighters arrived about five minutes later and saw flames and thick smoke coming out of the house, according to San Diego fire officials. Firefighters learned that several people were trapped inside.

Battalion Chief Mike McBride told OnScene TV crews immediately began removing bars that were blocking windows in the house. About 15 minutes after they arrived, a family member stuck in the house reached out through one of the windows and grabbed a firefighter by the arm, McBride said. Firefighters immediately cut bars and brought several residents to safety.

Firefighters who made their way to the back of the house located an elderly family member who managed to escape but was badly burned, McBride said. This person was immediately taken to hospital.

Six other family members were also taken to hospital. Their injuries were not specified. The seven victims were between 10 and 78 years old. Five are adults and two are children.

It took about an hour to bring the blaze under control and firefighters from La Mesa and El Cajon were called in to help. Firefighters estimate that the blaze caused approximately $ 500,000 in damage to the house and approximately $ 250,000 in damage to the contents of the house.

There was no obvious sign of foul play, McBride said.

Sunroad’s efforts to build a hotel on eastern Harbor Island have come a long, winding path over the past six years, repeatedly dwelling on concerns about the hotel’s design and the unwavering insistence of the Coast Commission for the Unified Port District of San Diego to commit to providing low-cost accommodation over the state’s tides.

“The port occupies a unique position as the public steward of these public coastal areas, and there is currently no low cost accommodation within the jurisdiction of the port,” said Kanani Leslie, Coastal Program Manager, “we So we encouraged them to pursue a real project rather than paying a fee.

Harbor commissioners acknowledged the particularly long time it took to get project approval, amid sometimes tense debates and divided council. Their vote on Tuesday was unanimous, with Commissioner Rafael Castellanos recusing himself and Jennifer LeSar absent.

Coastal planners and port staff have long disagreed on the need to address an amendment to the port district master plan before allowing the Sunroad project to proceed. In an email sent to port staff this week, Leslie reiterated the Coast Commission’s position on obtaining Coastal Commissioners’ approval.

“We continue to believe that a PMPA (Port Master Plan Amendment) would be the most appropriate process to address lower cost accommodations as well as to incorporate updated project details and public access provisions / measures. associated mitigation in the (master plan) ”Leslie wrote.

Harbor staff disagree, arguing that the existing master plan specifically calls for the development of a “high-quality hotel of approximately 500 rooms” on the Harbor Island site, “responsive to bay views. from San Diego, the airport and downtown San Diego. Diego’s horizon.

Leslie said no decision has yet been made on whether Coastal Commission staff will recommend appealing the approval of the port’s coastal development permit. Grading is underway for the Village Place Apartments project at 521 16th St.

The luxury apartment site is across from the Ramona Lutheran Church and close to the affordable 62-unit Schmale Family Senior Residence complex completed in summer 2019.

The Village Place apartments will consist of nine three-bedroom units and 16 two-bedroom units and will include garages, developer Bill Vaughan said. The two-story project will be housed in multiple buildings with a brown, beige and green color scheme, with stucco wood cladding and solar power, Vaughan said.

Vaughan is a superintendent at RA Burch Construction, the contractor for the Village Place project.

The four-year project went through a lengthy approval process with the Ramona Community Planning Group and the San Diego County Construction Department.

“I can’t wait to get the project started,” said Vaughan, a Ramona resident since 1978 who is also a co-owner of the project.

Vaughan said he did not know when the project would be completed, adding that cost estimates had not been finalized.

Motor Show for the benefit of the Ramona Senior Center

The Ramona Senior Center auto show will be held from 10 a.m. to 2 p.m. on Saturday, November 13 at Grace Community Church, 1234 Barger Place.

Muscle cars, classic vehicles, customs officers, motorcycles, hot rods and trucks will be on display at the corner of San Vicente Road and Barger Place. A silent auction, music by a DJ, and free hot dogs are included

The event will be presented by Ramona American Graffiti Cruise and The Over the Hill Gang Car Club.

Donations will be accepted from car owners. All donations go to support the Ramona Senior Center.

The church hosts the autumn bazaar with a shop and a mini craft fair

St. Mary’s-in-the-Valley Episcopal Church in Ramona will host its 25th Annual Fall Bazaar on Friday and Saturday November 12 and 13.

The bazaar kicks off with First Choice Night from 5:30 p.m. to 8 p.m. on November 12. The store will be open with a large selection of new and lightly used items, including two new car seats and two jogging strollers. A mini craft fair with handcrafted items will also be open during First Choice Night.

The next day, November 13, a parking sale will be open from 7 a.m. to 3 p.m. At 8 a.m., the boutique and the mini craft fair will reopen their doors. At 2 p.m., there will be a design for a double quilt, provided by Quilters Prayers and Squares. (The winner does not need to be present to claim their prize.) Tickets are $ 1 each, or six for $ 5 or 12 for $ 10. Tickets will be available at the Bazaar or by contacting Karen Cooke at 408-710-2193.

Topping the day is music performed by the Shirthouse Bluegrass Band from 10 a.m.

The church is at 12th Street and San Vicente Street. Proceeds from sales will go towards awareness programs both locally and nationally. The remaining items will be donated to In His Steps Christian Recovery, Gently Hugged, the Ramona Food & Clothes Closet, the Ramona Library and Goodwill.

Registrations for the Ramona 4-H club are scheduled for November 16

The Ramona Wrangler 4-H Club will have registrations at 7 p.m. on Tuesday, November 16 at the Ramona Junior Fair grounds, 431 Aqua Lane.
